Welcome to Intensiv Australia! The terms “we”, “us” and “our” refer to Intensiv Australia. Intensiv Australia operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”) together with any policies referenced herein describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, you may be asked to provide information such as your email address and billing, payment and shipping details. You represent and warrant that the information you provide is correct, current and complete, and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials and all activity under your account. You may not transfer or assign your account to any other person.

2. Our Products

We make every effort to present our products and services accurately. However, colours and appearance may differ from how they appear on your screen due to device settings. We do not warrant that the appearance or quality of any products will meet your expectations.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities to any person, geographic region or jurisdiction.

3. Orders & Backorders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Your order is not accepted until we confirm acceptance and process your payment. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after acceptance.

Backorders (Client-Specific Terms)

  • You will be informed of any backorders at the time of ordering and/or via your sales order confirmation or invoice.
  • Backorders from Intensiv in Switzerland may take 2–4 weeks.
  • Once ordered, an item will remain on backorder until supplied or cancelled by you.
  • We do not provide automatic updates on backorder progress, but can supply an ETA on request—this is only an estimate due to shipping uncertainties.

Your purchases are subject to return or exchange solely in accordance with our Returns section below and our Refund Policy.

4. Prices, GST & Billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include shipping or handling.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases and to promptly update your information (including email address and payment details) so we can complete your transactions and contact you as needed.

5. Shipping, Freight & Delivery

Freight (Client-Specific Terms)

  • A freight charge of $13.20 (including GST) applies to all orders of 3 items or less.
  • Orders of 4 items or more are freight-free.

Delivery (Template Terms)

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you.

6. Returns (Client-Specific Terms)

  • If you are unhappy with any aspect of your purchase, it can be returned for full credit against future purchases.
  • Return postage is to be paid by you.

7. Trading Terms & Payment (Client-Specific Terms)

  • Orders can be paid on the website during checkout or on your 30-day account.
  • Goods remain the property of Intensiv Australia until payment is made in full.
  • We accept payment via EFT and American Express, Mastercard, and Visa credit cards.
  • Credit card payments do not incur any surcharges.

8. Intellectual Property

The Services and their contents (including trademarks, text, images and design) are owned by Intensiv Australia, its affiliates or licensors and are protected by applicable laws. You may use the Services for personal, non-commercial use only unless otherwise authorised in writing.

9. Optional Tools & Third-Party Links

You may be provided access to third-party tools “as is” and “as available”, and you use them at your own risk. The Services may contain links to third-party websites; we are not responsible for their content or policies. Review third-party terms before engaging in any transaction.

10. Relationship with Shopify

Our store is powered by Shopify. However, any sales and purchases you make are directly with Intensiv Australia. Shopify is not responsible for any aspect of sales between you and Intensiv Australia, and you expressly release Shopify from all related claims.

11. Privacy

All personal information we collect is subject to our Privacy Policy. Because our Services are hosted by Shopify, Shopify may also collect and process certain personal information to operate and improve the Services. For details, see our Privacy Policy and Shopify’s privacy documentation.

12. Feedback

If you submit reviews, ideas or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use. You represent that you have all rights to the Feedback you submit.

13. Errors, Inaccuracies & Omissions

From time to time there may be information in the Services that contains typographical errors or inaccuracies (e.g., product descriptions, pricing, promotions, shipping charges, transit times and availability). We reserve the right to correct any errors, change or update information, or cancel orders if any information is inaccurate, at any time without prior notice (including after you submit your order).

14. Prohibited Uses

You may use the Services only for lawful purposes. You agree not to misuse the Services, interfere with security features, infringe intellectual property rights, or engage in fraudulent, abusive or harmful conduct. We may suspend or terminate access for violations of these Terms.

We may terminate or suspend access to the Services at any time without notice. You remain liable for all amounts due up to and including the date of termination. Sections that by their nature should survive termination will survive.

16. Disclaimer of Warranties

Except as expressly stated by Intensiv Australia, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title and non-infringement. Your use of the Services is at your sole risk.

17. Limitation of Liability

To the fullest extent permitted by law, in no case shall Intensiv Australia (or Shopify) be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Services or products, including lost profits, revenue, savings, data, replacement costs, or similar damages.

18. Indemnification

You agree to indemnify and hold harmless Intensiv Australia, Shopify, and our affiliates and personnel from any claims, losses, liabilities, damages and expenses (including legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.

19. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the unenforceable portion deemed severed, without affecting the validity of remaining provisions.

20. Waiver & Entire Agreement

Our failure to enforce any right or provision of these Terms is not a waiver of such right or provision. These Terms and any policies posted on the site constitute the entire agreement between you and us and supersede prior agreements (including prior versions of these Terms).

21. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms without consent.

22. Governing Law

These Terms and any separate agreements whereby we provide you Services are governed by the laws and courts of the jurisdiction where Intensiv Australia is headquartered (Australia). You and Intensiv Australia consent to venue and personal jurisdiction in such courts.

You can review the most current version of these Terms at any time on this page. We may update or change these Terms by posting updates to our website. It is your responsibility to check periodically for changes. We will notify you of any material changes in accordance with applicable law. Your continued use of the Services constitutes acceptance of changes.
